Does Puerto Rico Belong on the Dirty Money List?

The European Union has a list of places where banks may indulge in money laundering or terrorist financing. Puerto Rico has just been added to that list. The European Commission added quite a few places to the list this week, including Saudi Arabia, Panama, Nigeria, Puerto Rico, American Samoa, the U.S. Virgin Islands, and Guam.
This brings the list up to 23 jurisdictions.
Saudi Arabia and Panama both have protested, saying that they are working hard to keep their finances clean. Great Britain spoke up for Saudi Arabia, where the UK has a number of banks and other financial interests.
Puerto Rico Financial Institutions Commissioner George Joyner called the inclusion of Puerto Rico on the list of “high-risk” jurisdictions “laughable.” He complained that the European Commission had not consulted with Puerto Rico before making the decision. El Nuevo Dia reported that the criteria for the “dirty money” list appeared to include the perception of being a tax haven.
The United States spoke up for its territories, too. “The commitments and actions of the United States in implementing the FATF standards extend to all U.S. territories, and that the same Anti-Money Laundering and Countering the Financing of Terror (AML/CFT) legal framework that applies to the continental United States also generally applies to U.S. territories,” said the U.S. Treasury.
The European Commission says that the list doesn’t directly accuse anyone of wrongdoing, but calls out jurisdictions that have “strategic deficiencies” in their rules that may allow money laundering.

Consequences of the list

There are no sanctions against places that end up on the “dirty money” list, but European banks have to take extra steps to do business with financial institutions in those places. There may also be public relations issues if jurisdictions on the list are seen as untrustworthy.
This could affect Puerto Rico significantly, since the territory is working to establish credibility in financial markets. El Nuevo Dia described the listing of Puerto Rico as “outrageous.”
The EU has one month to confirm or change the new list. The United States has announced its rejection of the list, citing the fact that the European Commission didn’t contact the U.S. territories or give them an opportunity to contest the listing.

Territories, but no states

No U.S. states appeared on the list of jurisdictions considered “high-risk” by the EU. This is true even though the anti-money-laundering laws of the United States specifically apply to U.S. territories and states alike. This is specifically stated in the relevant guidelines: “For purposes of this requirement, the United States includes the states; the District of Columbia; the Commonwealth of Puerto Rico; the Commonwealth of the Northern Mariana Islands; U.S. territories and possessions, including Guam, American Samoa and the U.S. Virgin Islands; and Indian lands, as defined in the Indian Gaming Regulatory Act.”
Whether Puerto Rico is actually more financially risky than the states, or simply perceived that way, it is a problem of being a territory. Statehood would solve it.
Tell your legislators that it is time for statehood.

The recent reports about the negotiations with the US is the good and encouraging sign. The peaceful and negotiated transition of power seems to be the wise and rational choice, no pun on the wise choices and the wise men intended. 

The times change, the historical epochs change, and the historical personalities change, etc. 

However, we have to give the credit due to Maduro, and to admit that he is one smart politician, who knows how to build his alliances and how to manage them, and one tough cookie - Jewish boy, a la Fidel. 

Whatever and whoever he is, the sooner the transition, the better it seems to be for everyone. 

Trump's enthusiastic insistence on Russia's readmission into G-7 (=7,5) appears to be the part of this equation of Venezuela's transition; in this TrumPutin geopolitical world, where the horse trading and the horse plays appear to be the name of the game.

The Venezuelan government on Wednesday foiled an assassination attempt against the democratically elected President Nicolas Maduro, which envisioned a group of rogue officers storming the presidential palace and installing an imprisoned general in his stead.
Information Minister Jorge Rodriguez said former soldiers and police had plotted to kill Maduro, his wife Cilia Flores and the president of the pro-governmental constituent assembly, Diosdado Cabello.
Rodriguez said the plotters had planned to release jailed ex-general Raul Isaias Baduel from prison and declare him president, the El Universal newspaper reported. Rodriguez identified the governments of Colombia and Chile as the masterminds behind the alleged coup attempt. Maduro himself spoke of "a power-obsessed minority planning violence and war."
Maduro escaped an actual attempt on his life last year, when drones carrying explosives went off in front of him as he spoke at a National Guard ceremony in Caracas. The president was unharmed, but seven National Guard soldiers were injured.
For the third time this year, the U.S' attempt to remove President Nicolas Maduro from power in May turned out to be a bust. After an uprising in Venezuela quickly fizzled out, Maduro blamed the U.S. government for orchestrating a coup attempt against his country.
The military has so far supported Maduro and refused to back opposition leader Juan Guaido, who declared himself interim president in January and has backing from dozens of countries, including most of Latin America and the U.S. Maduro has called Guaido a U.S-backed puppet who seeks to oust him in a coup.
Venezuela has been rocked by protests since Jan. 10, when Maduro was sworn in for a second term following a vote boycott by the opposition. Tensions climbed on Jan. 23 when Juan Guaido declared himself interim president, but Maduro has so far refused calls to step down.
Some in the Donald Trump administration thought they would achieve their mission in January, when the U.S. formally recognized Guaido and around 50 other nations followed suit. Others thought it might end in February, when the opposition entered the country with trucks of U.S. aid to help the people of a once prosperous country, where many now go without food and medicine amid a deep economic crisis.

European Union governments unanimously rejected a list of foreign jurisdictions posing higher risks of money laundering, criticizing officials in Brussels for drawing up the document in a flawed manner.
The list was presented last month by the European Commission, the EU’s executive arm, as a measure to protect the financial system from dirty-money risks stemming from outside the bloc. It ranked Saudi Arabia alongside Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa and Panama as jurisdictions posing increased risks of illicit finance. EU banks would have to apply tougher checks on transactions involving these regions.
EU member states “cannot support the current proposal that was not established in a transparent and resilient process,” according to a statement from the Council of the EU, which represents national governments. They called for a list “that meets our high standards and thereby further strengthens anti-money laundering and the combat against terrorist financing.”
According to diplomats involved in the process, the rejection also reflects concerns that member states weren’t properly consulted during the process, and that the document could have been challenged too easily by some of the 23 targeted jurisdictions.

Quickly Criticized

The U.S. Treasury also quickly criticized the list, saying it didn’t get enough time to respond, nor “any meaningful opportunity” to challenge the document. Vera Jourova, the EU commissioner in charge of the proposal, on Thursday denied these allegations, saying the EU executive “engaged with the third countries concerned” as well as with experts from the bloc’s member countries.
The back-and-forth over the measure comes as European banks are being rocked by revelations that they played a part in shoveling dubious funds from the former Soviet Union to the West. The EU governments said they are “strongly committed to the fight against money laundering and terrorist financing,” adding that “further progress is needed in our joint fight.”

Puerto Ricans from all walks of life mobilized in Old San Juan on Wednesday night for one of the largest protest in the island's history — 100,000 to 500,000 people shouting "Ricky, Renuncia!" ("Ricky, Resign!") at the island's governor, Ricardo Rosselló.
People have been protesting everyday in San Juan and other parts of the island for a week, demanding Rosselló's ouster. So far, there's no indication they will stop anytime soon.
This is a historic moment for an island that is not largely known for mass mobilization or protests — even after it was destroyed by Hurricane Maria in 2017, the deadliest natural disaster in U.S. history. After a storm that resulted in the deaths of at least 2,975 people and no electricity for months — even a year for some parts of the island — there were no protests in the streets.
So what got Puerto Ricans to this point? Here are five things to know.

It started with leaked private chats


On July 8, local media outlets published excerpts of profanity-laced and derogatory private chat messages between Rosselló and some administration officials and some close associates, including lobbyists.
A few days later, the island's Center for Investigative Journalism (known as CPI for their name in Spanish) published 889 pages of the chats — and that's when public anger ignited, leading to the protests.

What’s in the chats?


The chats, on the encrypted messaging app Telegram, shocked islanders for their vulgarity and crassness and raised questions about possible conflicts of interest and violations of the law.
There were insults: The group made fun of an obese man the governor had posed with in a photo; called former New York City Council Speaker Melissa Mark-Viverito a “whore”; made homophobic remarks about pop star Ricky Martin; and said that Carmen Yulín Cruz, the mayor of San Juan who had announced her intent to run for governor against Rosselló in 2020, was “off her meds ... either that, or she’s a tremendous HP,” the governor said, using the Spanish initials for “son/daughter of a b----.”
The group also made jokes about the corpses that piled up after Hurricane Maria, something that struck a chord among many Puerto Ricans and is repeatedly mentioned during the protests.
Puerto Ricans also got a window into the administration's efforts to steer the media narrative and smear political opponents. In the chat, politicians also shared confidential government information with people who were not public officials.
Beyond the insults, island and federal authorities are investigating whether the chats point to wrongdoing such as corruption or conflicts of interest.

Who’s in the chat?


The members of the chat group were Luis Rivera Marín, Rosselló’s secretary of state; Christian Sobrino, who held a series of economic posts; Alfonso Orona, Rosselló’s former chief legal officer; Ramón Rosario, former public affairs secretary; Raúl Maldonado, former chief financial officer; one-time communications aides Carlos Bermúdez and Rafael Cerame; Edwin Miranda, a communications consultant; Interior Secretary Ricardo Llerandi; Public Affairs Secretary Anthony Maceira; and Elías Sánchez, a lobbyist and Rosselló’s former campaign director.
The Center for Investigative Journalism published an investigation alleging that the messages show glimpses of a multibillion-dollar corruption network as well as the use of public resources to do partisan work.
According to CPI's investigation, Rosselló was aware that Sánchez, Miranda and Bermudez were giving preference to companies that Sánchez lobbies for and granting them government contracts — some of which were funded with federal money.

Why the calls for Rosselló's resignation?


Many see the leaked chats as the last straw for an island still struggling to recover from a devastating hurricane, all amid a decade-long financial crisis.
The messages were also leaked on the same week Puerto Rico's former secretary of education, Julia Keleher; former Puerto Rico Health Insurance Administration head Ángela Ávila-Marrero; and four others with government contracts under Rosselló’s administration were arrested and charged with 32 counts of money laundering, fraud and other related charges for allegedly embezzling $15.5 million in federal funding from 2017 to 2019.
The Rosselló administration has been rocked by various other corruption investigations since June. Rosselló ousted Maldonado as chief financial officer after Maldonado said on a radio show that Puerto Rico’s Department of Treasury is run by "an institutional mafia of many years.”
The FBI is also investigating the finances and donation requests of Unidos por Puerto Rico, the nonprofit organization created by Rosselló's wife, Beatriz Rosselló, to handle Hurricane Maria-related donations.
Unidos por Puerto Rico, which received $41 million in donations, was run for a time by Jorge del Pino, the brother-in-law of lobbyist and group chat member Elías Sánchez.
Well over 45 public officials have either resigned or been fired since Rosselló became governor in 2017.

Will Rosselló resign or be impeached?


In the wake of the revelations, Puerto Rico’s Department of Justice and the Office of Government Ethics has launched investigations into what has been dubbed #TelegramGate or #RickyLeaks to determine whether the leaked conversations — showing public officials, lobbyists and others discussing public policy issues and party politics — point to possible law violations.
The president of Puerto Rico’s House of Representatives, Carlos Méndez Núñez, appointed three lawyers to investigate the contents of the leaked chats to see if there's reason to start an impeachment process.
Puerto Rico House Rep. Dennis Márquez already introduced a resolution to initiate impeachment proceedings against Rosselló, outlining 18 possible crimes that stem from the leaked chats.
Rosselló has doubled down multiple times on his plans to remain as governor, amid dozens of calls from people inside his pro-statehood party and other sectors to step down.
Democratic 2020 presidential candidate Julián Castro, who made Puerto Rico his first campaign stopafter announcing his candidacy, became the first presidential hopeful to call for Rosselló's resignationat a press conference with reporters. Sen. Elizabeth Warren did too, tweeting that "the people have spoken, loud and clear" and Rosselló should resign. Other Democratic candidates including Sens. Bernie Sanders and Kirsten Gillibrand as well as Rep. Tulsi Gabbard and Marianne Williamson have also said publicly they stand with the people of the island.
According to Puerto Rico’s constitution, if the governor’s seat is vacant, the secretary of state is next in line. But Rosselló’s secretary of state, Luis Rivera Marín, resigned in the wake of the leaked chats.

Donald Trump has rowed with his fellow G7 leaders over his demand that Russia be readmitted to the group, rejecting arguments that it should remain an association of liberal democracies, according to diplomats at the summit in Biarritz.
The disagreement led to heated exchanges at a dinner on Saturday night inside the seaside resort’s 19th-century lighthouse. According to diplomatic sources, Trump argued strenuously that Vladimir Putin should be invited back, five years after Russia was ejected from the then G8) for its annexation of Crimea.
Of the other leaders around the table, only Giuseppe Conte, the outgoing Italian prime minister, offered Trump any support, according to this account. Shinzo Abe of Japan was neutral. The rest – the UK’s Boris Johnson, Germany’s Angela Merkel, Canada’s Justin Trudeau, the EU council president, Donald Tusk, and the French president, Emmanuel Macron – pushed back firmly against the suggestion.
“On that point … it became a bit tense to say the least,” a European diplomat said. “Most of the other leaders insisted on this being a family, a club, a community of liberal democracies and for that reason they said you cannot allow President Putin – who does not represent that – back in.”
“That is not such a very important thing for [Trump]. He doesn’t share that view,” the diplomat added. According to this account Trump argued that on issues such as Iran, Syria and North Korea, it made sense to have Russia in the room. “So he had a really kind of fundamental difference about this.”
The summit is being hosted on Biarritz’s Atlantic seafront, which has been entirely sealed off for the event. Encouraged by warm breezes and mostly sunny skies, several of the leaders chose to walk from their grand hotel to the venue for the talks along the deserted and heavily guarded beach in front of the city’s casino.
In breaks in the negotiations, they have been treated to the best of the Basque region’s cuisine, prepared by top local chefs and kitchen staff from the Élysée Palace.
Below the pleasantly gilded surface, however, there has been an undercurrent of bitterness and anxiety at the summit. Boxed in by multiple global crises, the group of major industrialised democracies is arguably at its most divided since its founding in 1977.
Trump has been arguing for Russian readmission since the G7 summit in Quebec last year and appeared determined to revive the demand, bringing it up in a discussion about Iran policy and taking his counterparts by surprise with the vehemence of his views on the subject.
There was nervousness about Trump’s arrival, in the midst of a trade war with China and his reportedreluctance to attend, arguing it was not a good use of his time. At the previous summit in Quebec, Trump left early and ordered US officials to withdraw his agreement to a joint communiqué. As a precaution this year, Macron decreed there would be no communiqué to withdraw from.
In an attempt to win over Trump, Macron staged a benign ambush as the US president arrived, whisking him off to an unscheduled lunch, where the two men talked without officials or aides for nearly two hours.
Trump later tweeted that it was “the best meeting we have yet had”, though he misspelt the French president’s name and accidentally linked to a parody Macron account, which has since been suspended.
Macron’s tactics infuriated some US officials, who called several members of the travelling White House press on Saturday afternoon to leak against the French host, claiming he had filled the summit agenda with “niche” subjects such as climate change and equality with his own domestic audience in mind, rather than sticking to global economics and trade, which have traditionally been the focus of G7 meetings.
Speaking anonymously, the officials also claimed it was only on US insistence that there would be a summit session on economics and trade at all, a claim denied by the French, and undermined by the existence of earlier drafts of the agenda, which all had such a session included.
When the time came for the leaders to gather outside the 1830s lighthouse, dating from the reign of King Louis Philippe, a scheduled group photo was unexpectedly cancelled. The reason for the cancellation was not explained, though officials pointed out there was a bigger family photo, including invited guest leaders from India, Australia, Spain, South Africa and several other African states.
Not included was a surprise guest who flew in on Sunday afternoon: the Iranian foreign minister, Mohammad Javad Zarif, at the invitation of his French counterpart, Jean-Yves Le Drian. France has been pursuing an initiative to defuse tensions in the Gulf, and French officials said Zarif’s sudden appearance was a continuation of those efforts. They insisted Trump had been informed of the unexpected arrival. The US president refused to comment.
Next year it will be Trump’s turn to choose outside guests as he takes his turn at hosting the G7 against the backdrop of his re-election campaign. European diplomats on Sunday were betting that Putin would be on top of his list.
Giving Government Permanent Authority To Spy on Everyone in America

While most of us have been thinking about the end of summer and while the political class frets over the Democratic presidential debates and the aborted visit of two members of Congress to Israel, the Trump administration has quietly moved to extend and make permanent the government’s authority to spy on all persons in America.
The president, never at a loss for words, must have been asked by the intelligence community he once reviled not to address these matters in public.
These matters include the very means and the very secret court about which he complained loud and long during the Mueller investigation. Now, he wants to be able to unleash permanently on all of us the evils he claims were visited upon him by the Obama-era FBI and by his own FBI. What’s going on?
Here is the backstory.
After the lawlessness of Watergate had been exposed – a president spying on his political adversaries without warrants in the name of national security – Congress enacted in 1978 the Foreign Intelligence Surveillance Act. It prescribed a means for surveillance other than that which the Constitution requires.
The Fourth Amendment to the Constitution – written in the aftermath of British soldiers and agents using general warrants obtained from a secret court in London to spy on whomever in the colonies they wished and to seize whatever they found – was ratified as part of the Bill of Rights to limit the government’s ability to intrude upon the privacy of all persons, thereby prohibiting those procedures used by the British.
Thus, we have the constitutional requirements that no searches and seizures can occur without a warrant issued by a judge based on a showing, under oath, of probable cause of crime. The courts have uniformly characterized electronic surveillance as a search.
I am not addressing eyesight surveillance on a public street. I am addressing electronic surveillance wherever one is when one sends or receives digital communications. FISA is an unconstitutional congressional effort to lower the standards required by the Fourth Amendment from probable cause of crime to probable cause of foreign agency.
Can Congress do that? Can it change a provision of the Constitution? Of course not. If it could, we wouldn’t have a Constitution.
It gets worse.
The court established by FISA – that’s the same court that President Donald Trump asserts authorized spying on him in 2015 and 2016 – has morphed the requirement of probable cause of being a foreign agent to probable cause of communicating with a foreign person as the standard for authorizing surveillance.
What was initially aimed at foreign agents physically present in the United States has secretly become a means to spy on innocent Americans. In Trump’s case, the FISA court used the foreign and irrelevant communications of two part-time campaign workers to justify surveillance on the campaign.
Add to all this the 2002 secret order of President George W. Bush directing the National Security Agency to spy on all in America all the time without warrants – this is what Edward Snowden exposed in 2013 – and one can see what has happened.
What happened?
What happened was the creation of a surveillance state in America that came about by secret court rulings and a once-secret presidential order. As a result of this, part of the government goes to the secret FISA court and obtains search warrants on flimsy and unconstitutional grounds and part of the government bypasses FISA altogether and spies on everyone in America and denies it and lies about it.
Bill Binney, the genius mathematician who once worked for the NSA and now is its harshest critic, has stated many times that, as unconstitutional as FISA is, it is a pretext to NSA spying on all persons in America all the time.
How pervasive is this unlawful spying? According to Binney, the NSA’s 60,000 domestic spies capture the content and the keystrokes of every communication transmitted on fiber optic cables into or out of or wholly within the United States. And they do so 24/7 – without warrants.
Now, back to that quiet late summer proposal by the Trump administration. Some of the statutes that govern who can go to the FISA court and under what circumstances they can go are about to expire. Inexplicably, the president once victimized by FISA wants to make these statutes permanent. And he wants to do so knowing that they are essentially a facade for spying. That would institutionalize the now decades-long federal assault on privacy and evasion of constitutional norms.
It would also place Trump in the same category as his two immediate predecessors, who regularly ordered government agents to violate the Fourth Amendment and then denied they had done so.
Some of my Fox colleagues joke with me that I am shoveling against the tide when it comes to defending the right to privacy. They claim that there is no more privacy. I disagree with them. As long as we still have a Constitution, it must be taken seriously and must mean what it says. And its intentionally stringent requirements for enabling the government to invade privacy remain the law of the land. The president has sworn to uphold the Constitution, not the NSA.
The late Supreme Court Justice George Sutherland once wrote that we cannot pick and choose which parts of the Constitution to follow and which to ignore. If we could, the Constitution would be meaningless.
Did he foresee our present woes when he wrote, "If the provisions of the Constitution be not upheld when they pinch as well as when they comfort, they may as well be abandoned"?
